Flexicom Warranty
Flexicom Limited Comprehensive Product Warranty Agreement**
Warranty Coverage and Extent
Flexicom Limited (“Flexicom”) warrants that its products shall be devoid of material defects in craftsmanship and will perform in accordance with the Product Descriptions as detailed in the certified drawings, final invoices, product brochures, and manuals at the time of shipment. The warranty encompasses the following specifics:
– Electrical components and castors are warranted for a period of two (2) years from the date of shipment.
– Metal fabrication components are warranted for a period of twenty-five (25) years from the date of shipment.
Flexicom shall undertake to repair or replace any product found to be defective within its designated lifespan, provided that:
– The product is utilized strictly in accordance with Flexicom’s prescribed guidelines.
– The defect is not a result of misuse, neglect, improper handling, or storage.
– The product remains unaltered and has not been repaired by any unauthorized third parties.
Procedures for Warranty Remediation and Claims Filing
All claims under this warranty must be initiated through the designated contact channels of Flexicom. Upon validation of a claim, Flexicom retains the discretion to either repair or replace the defective product without extending the original warranty period. Defects must be reported within seven (7) days of their discovery, and returns must be pre-authorized by Flexicom.
Limitations of Liability
Flexicom’s product warranties are inclusive of guarantees that are non-excludable under the Australian Consumer Law. The purchaser is entitled to either replacement or refund for major failures and compensation for any other reasonably foreseeable loss or damage. Additionally, purchasers may obtain repairs or replacements for goods that fail to meet acceptable quality and do not constitute a major failure.
Beyond these statutory rights, Flexicom expressly disclaims all other warranties, either express or implied, to the fullest extent permissible by law. Liability is limited to the lesser of the cost of product replacement, repair, or acquisition of equivalent products.
General Terms and Conditions**
This warranty is valid solely for the original purchaser and is non-transferable unless explicitly authorized in writing by Flexicom. Flexicom reserves the right to assign transferable warranties from the manufacturers or suppliers of components to the customer, without assuming additional liability. Amendments to this warranty must be executed in writing and ratified by an authorized representative of Flexicom. Flexicom also reserves the right to modify or terminate this warranty in instances of delayed payments or non-receipt of payments, with potential for reinstatement at its discretion.
Exclusions from Warranty**
This warranty does not cover:
– Damage resulting from adverse operating conditions, unauthorized repairs, accidents, or misuse contrary to Flexicom’s prescribed usage.
– Products with altered or removed serial numbers.
– Normal wear and tear, including consumables like air filters and surge protection devices, which are recommended for replacement every 2 to 3 years.
– Costs related to product installation, removal, transportation, and routine maintenance.
The warranty becomes void if the product is stored inappropriately post-shipment or if start-up and commissioning are performed by unauthorized personnel.
Consumer Rights
This warranty upholds and respects the rights accorded under the Australian Consumer Law and other pertinent legislation, ensuring that no statutory consumer guarantees are excluded, restricted, or modified.
